Abercrombie & Fitch CEO Mike Jeffries' attorneys have filed a last-ditch bid to prevent him from standing trial for penis enlargement cosmetic surgery allegedly sex trafficking and prostituting male models. 

The 80-year-old exec's lawyers, Brian Bieber, and Alek Ubieta, filed a motion on Thursday citing multiple doctor evaluations that concluded Jeffries was unfit to stand trial due to severe dementia. 

Jeffries attorneys argued that he was 'suffering from a mental disease or defect rendering him mentally incompetent' and was unable to understand the court proceedings. 

The court filing cites the conclusions from four doctors, who stated that Jeffries was suffering a major neurocognitive disorder that was incurable. 

Doctors Alexander Bradley and Miranda Rosenberg concluded that Jeffries met the criteria for Alzheimer's disease, traumatic brain injury and Lewy Body disease, which is a type of dementia. 

'His cognitive deficits significantly impair his ability to understand the nature and consequences of the charges, consult with counsel in a rational manner, and participate in his defense "with a reasonable degree of rational understanding,'' the doctors stated in the filing. 

Dr. Cheryl Paradis backed up the dementia diagnosis and said that a symptom of the disease is 'erratic behavior,' warning that if Jeffries participated in the trial, he could 'blurt out self-incriminating statements' and harm his credibility. 

The defense asked that Jeffries should be hospitalized for four months to see if he regains competency.

Jeffries was charged with multiple counts of sex trafficking and prostitution for alleged abuse against male models while he was CEO. He was arraigned in New York on October 25, 2024 (pictured) 





Doctors cited in the court filing said that Jeffries' condition was consistent with dementia and his cognitive deficits would impair his credibility if he testified 

The filing argues that after four months, Jeffries should be released to home confinement. 

Jeffries attorneys state in the filing that the prosecution had no objections to the defense's request. 

If District Judge Nusrat J. Choudhury accepts the defense's motion, Jeffries will have to self-surrender at a medical facility chosen by the Attorney General's office. 

Jeffries was previously released from custody after he paid the $10 million bond for accusations that he abused 15 young male models from 2008 to 2015. 

His lawyers argued in December that Jeffries was suffering from dementia, but the new court filing cites three additional doctors to support the diagnosis. 

Jeffries was arrested on charges of sex trafficking and interstate prostitution in October. 

He was taken into custody alongside his longtime partner, Matthew Smith, 61, in West Palm Beach.

Jeffries' associate, Jim Jacobson, was also arrested for the alleged sex crimes in Wisconsin. He was later released on a $500,000 bond.

Jeffries pled not guilty to the charges against him during an arraignment on October 25, 2024 

The former Abercrombie boss was accused of running a prostitution ring while he ran the company, allegedly sexually assaulting at least male models during his tenure as CEO. 

Jeffries was Abercrombie's CEO from 1992 to 2014 when he allegedly abused his power and coerced young male models into horrifying sex acts. 

The victims said they were forced to take erection drugs and had their genitals shaved against their will. 

James Dennehy, who was the Assistant Director in Charge of the FBI's New York office, said at the time of the arrests that the three men allegedly 'preyed on the hopes and dreams of their victims by exploiting, abusing, and silencing them to fulfill their own desires, with insidious secret intentions.' 

Prosecutors alleged that the illegal acts occurred in multiple countries including the US, England, France, Italy, Morocco and Saint Barthelemy. 

Jeffries allegedly used a company called the Jeffries Family Office to recruit staff for the 'sex parties,' where multiple models aspiring to work for Abercrombie were allegedly abused. 

The 'staff' allegedly forced the attendees to take muscle relaxants, also known as 'poppers' and were provided with lubricant, Viagra and condoms. 

The victims were also allegedly forced to 'wear costumes, use sex toys or prepare for particular sexual acts,' according to court documents.




Jeffries served as the CEO of Abercrombie & Fitch from 1992 to 2014. The allegations against him were dated from 2008 to 2015 





Jeffries, along with his longtime partner Matthew Smith and associate Jim Jacobson, were named as perpetrators of the abuse in court documents 

Smith and Jeffries were accused of injecting men in their genitals with 'a prescription-grade erection-inducing substance' that caused painful, hours-long reactions to get them to engage in sex acts.' 

Jeffries, Smith, and Jacobson were all accused of sexually assaulting the men and assisting in the alleged prosecution ring. 

Jacobson was cited in court documents as a recruiter who allegedly traveled to interview men for the sex parties, under names that weren't his own. 

Prosecutors say the victims were never informed what they were being recruited for and didn't know 'the full extent and nature of the sexual activity that would be required' which allegedly included 'anal intercourse, the insertion of large sex toys into the anus, and high-pressured enemas administered by inserting a hose into the anus.'

The alleged abuse that occurred under Jeffries was chronicled in a BBC documentary titled, The Abercrombie Guys: The Dark Side of Cool. 




Barrett Pall, a former Abercrombie model and activist, has spoken out about the abuse he endured while working for the company 







Accusers Barrett Pall and David Bradberry said they were invited to an interview, which eventually involved unwanted sex acts. 

They corroborated the prosecution's accusations and detailed horrific abuse at 'sex parties,' where they felt unsafe and coerced. 

Pall posted on his Instagram after the recent court filing, writing, 'This is not the end, but it is one of those moments where you just can't help and think - RIGHTTTTTTTTTTTTTTT - do I even matter? Does this even matter? And no matter what happens - WE DO.' 

Brad Edwards, a lawyer who is representing victims in a civil case against Jeffries told the Wall Street Journal, 'We hope he [Jeffries] is rehabilitated and faces the penalty he deserves. Regardless, he cannot and will not avoid liability in our civil class action lawsuit.'
